Supreme Court Strikes Down CDC Moratorium
On last Thursday, the U.S. Supreme Court ruled in a 6-3 vote that the Center for Decease Control (CDC) acted outside the scope of its authority when enacting the federal moratorium. In the majority opinion the courts made clear "If a federally imposed eviction moratorium is to continue, Congress must specifically authorize it”.
While the justices rejected the Biden administration's arguments in support of the CDC's authority, we anticipate a congressional push to reinstate the moratorium. Progressives have already sent communication to Majority leader Schumer and Speaker Pelosi to take legislative action. We will continue to monitor the developments as they unfold.
